Smoke control area log burner: two checks before you buy

A closed log burner on a hearth, the kind of appliance smoke control rules restrict

On a smoke control area log burner, wood is lawful only in an exempt model used as stated. Ecodesign is a different sale rule. Ask your local council first.

You have a terrace, a chimney, and a stove page that says Ecodesign or DEFRA approved. A smoke control area log burner is lawful on wood only when two checks both pass. You need to know whether the address is inside a smoke control area, and the exact model has to be exempt for the fuel you will burn, used as that exemption states.

GOV.UK's smoke control rules give England two maximums: up to £300 if a chimney releases smoke, and up to £1,000 for buying unauthorised fuel for an appliance that is not approved. Those amounts are the England wording. Scotland, Wales, and Northern Ireland each need their own text and their own council.

Peter F. checked the GOV.UK rules, Defra's exempt appliance search, the HETAS guide that separates Ecodesign from a Defra exemption, and Bradford Council's note on solid-fuel appliances, in October 2026. We did not run a lab test, and we did not match a shopping-page badge to the exempt list. A qualifying purchase through our links can earn us a commission at no extra cost to you.

In short

Ask your council whether the address is in a smoke control area, then find that exact stove on Defra's exempt list for the fuel you will burn. Wood is allowed only when the entry exists and you follow its conditions. An Ecodesign label, certified logs, and a stove fan leave that test unchanged, and the £300 and £1,000 ceilings are the England figures on GOV.UK.

What a smoke control area restricts

A smoke control area is a place where the council limits the smoke a chimney may release. GOV.UK states the lawful choice directly. You burn an authorised fuel, or you burn another fuel in an appliance that is exempt for it. Wood in a log burner is allowed only when that model is exempt for wood and you run it as the exemption requires.

The limit sits at the chimney. Glass, a tight door, and a quiet fan can dress an appliance that is still wrong for the street. Councils draw the boundary street by street. The designation belongs to the address, so a house move starts the check again.

The smoke control penalty in England is those two ceilings: up to £300 for chimney smoke, and up to £1,000 for buying unauthorised fuel for a non-approved appliance. Scotland, Wales, and Northern Ireland keep their own enforcement.

GOV.UK names the local council, and the environmental services team holds the map. A product title, a previous owner, or a nationwide shop does not hold it. If you rent, check before you light anything, and treat the landlord's consent as a separate tenancy question.

Authorised fuel or a Defra exempt stove

Authorised fuel and a Defra exempt stove are different permissions. Authorised fuel is smokeless fuel you may burn without an exemption on the appliance. A Defra exempt stove is a named model that may burn a stated fuel, wood included, when you meet the conditions. Logs need that second permission. The exemption is what makes the load lawful on a covered street.

The entry names the fuel and how you operate the stove. A model cleared for one wood briquette is cleared for that briquette, not for any hardwood you split yourself. If the exemption depends on the air controls in the instructions, an overnight smoulder steps outside it. Read the entry and keep it with the invoice.

Search at smokecontrol.defra.gov.uk using the rating-plate identity. A shopping title often drops the output or the version, and an empty result means you have no exemption to rely on. amazon.co.uk bullets sometimes say DEFRA approved. On the fixed stoves we compared, that line stayed a listing claim and was not matched to the exempt list. A wood-burning stove row can show output, weight, flue collar, and that claim together. It shortlists a size. It does not enrol the model. Wood on a multifuel grate still needs the wood exemption.

Portable stoves are a different purchase. The wood stove comparison covers cook kits and tent stoves, and none of that set is documented here as Defra exempt. A summerhouse flue is still attached to an address. Ask the council before you treat a hobby room as outside the area.

Ecodesign is a different rule

Ecodesign is a sale rule. From 1 January 2022, solid-fuel stoves sold in England have had to meet that product standard, which Bradford Council's solid-fuel note records. The same note keeps the smoke control limit: the area still needs an authorised appliance. HETAS's consumer guide splits the two the same way. Ecodesign qualifies a new stove for the shop. A Defra exemption is how a stated fuel becomes lawful at the address.

A model can meet the sale standard and be missing from the exempt list. An older stove can pre-date 1 January 2022 and still be exempt for wood. A stove bought last month can show an energy label and still be the wrong appliance for logs on your street. The receipt dates the shop sale. The list answers the chimney. Search the plate, and ask the council about the address, before you treat the two stamps as one.

Treated timber, painted offcuts, household waste, and any unnamed fuel stay outside what you may load. If your only proof is the word Ecodesign, you still need a street fact. An Ecodesign stove in a smoke control area is lawful on wood only after the exempt entry is found. Certified logs in small volumes in England are a moisture rule, and they do not add the stove to the exempt list. Dry wood burns more cleanly. It never supplies the permission on its own.

Check your street before you buy

Start with the council for the building, which may not be your work council. Ask environmental services for a yes or no on that house. A postcode can contain both sides of the line, so keep a written answer for the full address, including the flat number.

If the house is covered, search the exact model before you pay. Read the fuel and the operating conditions, and file them with the invoice. If the model is absent, change the stove or change the fuel. Authorised smokeless fuel is the path without an exemption. Wood is the path that needs one. Whether you can burn wood in a smoke control area is settled for one model, one fuel, and one set of conditions. A smoke-exempt title on the box is the claim you still have to test.

Leave several days between the council question and the fitting. The Defra search takes minutes once the plate number is in front of you. A stove the last owner left behind did not arrive with an exemption. Look it up as if you had paid for it that week. The previous owner's habit is not a record you can show the council.

Environmental services will not size the room or fit the liner. In England and Wales, notification for a fixed solid-fuel stove goes through HETAS or building control. In Scotland and Northern Ireland, ask the council which route applies. Finish both the fuel check and the building notice before the first load of wood.

What the rules do not let you claim

A stove fan moves warm air into the room. It leaves the flue, the fuel, and the exemption alone. On a non-exempt stove burning wood in a covered street, the fan changes nothing. Fit one after both checks pass, and only if the maker allows the weight and the heat on the plate. The Valiant FIR361 in that comparison is a heat-powered four-blade fan at about £39.99, with 4.5 from 2,228 amazon.co.uk reviews. It circulates air. The exempt list is the permission.

Comparisons here record listing text, prices in GBP, and review counts from amazon.co.uk. They do not place a model on the exempt list. The England ceilings stay in England. A stove that was lawful in your last house needs the check again, because the area belongs to this address. An open grate needs its own exemption, or authorised fuel.

Smoke in the room, a damaged flue, or a carbon monoxide alarm is a safety stop. Put the fire out and call a competent person before you look up paperwork. We have not measured emissions from any appliance in this hub. This page is not an exemption letter, a council decision, or advice on a notice you have already received. Light what is already on the hearth only when both checks are in writing.

Common questions

How do I know if I live in a smoke control area?
Ask the council for that address, and ask environmental services, the team GOV.UK names. A map or postcode tool is a first look only, because a postcode can straddle the boundary, so keep a written answer for the house. A neighbour's stove, an old smokeless-zone rumour, or a spot outside a city centre does not settle it. If you rent, check anyway. The designation follows the building. Ask before you buy, because delivery day is a poor moment to learn the street is covered.
Can I burn wood in a smoke control area?
You can burn wood when that model is exempt for wood and you follow the conditions, including the fuel the entry names. If it is not exempt, use an authorised fuel. A closed door, an Ecodesign plate, or a dry bag of hardwood does not replace the list. Outside a smoke control area this wood rule does not bind the address, and you still fit the stove properly. If you are unsure which side of the line you are on, ask the council before the first fire.
What is a Defra exempt appliance?
It is one model on Defra's exempt list, allowed to burn a named fuel in a smoke control area when you meet the conditions. Those conditions fix the fuel and the way you run the stove. Search the plate details at smokecontrol.defra.gov.uk and read the whole entry. Another output from the same brand can be missing. If the exact model is not there, you do not yet have an exemption. Keep the entry with the manual.
Does an Ecodesign stove allow any fuel?
Ecodesign is the product standard for stoves sold as new. Bradford Council records that in England this sale rule has applied since 1 January 2022, and that a smoke control area still needs an authorised appliance. HETAS keeps the exemption as a separate list. You burn the fuel that entry names, which leaves out rubbish, treated wood, and any log the entry does not cover. An Ecodesign stove that is missing from the list does not make wood lawful on a covered street.
What is the smoke control penalty in England?
GOV.UK gives two maximums for England. Smoke from a chimney can bring a penalty of up to £300. Buying unauthorised fuel for an appliance that is not approved can bring a fine of up to £1,000. They are ceilings for the offences that page describes. They are a reason to finish both checks before you burn wood. This page is not advice on a notice already served. If the council has written to you, answer that letter on its own terms.
Do the England fines apply in Scotland and Wales?
Keep the £300 and £1,000 maximums for England. They are the wording on the GOV.UK page for that nation. Scotland, Wales, and Northern Ireland each apply their own smoke control arrangements. Ask the council for the property, and use the exempt list that covers that nation. A move from an English town to Cardiff, Glasgow, or Belfast starts both checks again. The stove does not carry the old street's permission with it.
Does a stove fan change the rules?
A stove fan circulates warm air in the room. It does not stop smoke in the chimney, and it is not an exempt appliance, so it cannot make wood lawful on a non-exempt stove in a smoke control area. Once the stove and the fuel are lawful, a fan can still help if the top plate suits it and the maker allows it. A claim that a fan cleans the burn is a claim about comfort. The stove fan comparison covers blades and heat, not approval to burn.
Who should I ask before I install?
Ask environmental services whether the address is covered and which fuel route applies. Then use an installer who will fit the stove to the exemption and to the building rules where you live. In England and Wales, notification for a fixed solid-fuel stove goes through HETAS or building control, and that step does not replace the exempt-list check. In Scotland and Northern Ireland, confirm the route with the council. If the model is not listed and the street is covered, choose another appliance or an authorised fuel first.
