Fire basket garden rules

Updated: 21 October 2026

You want a fire outside, and you have heard that a smoke control area bans it. Outdoor smoke and chimney smoke are different rules. A grate is not a garden basket unless the listing says outdoor. These fire basket garden rules cover what GOV.UK allows, where fire services say to put the pit, and which of these listings even claim the garden. The products are on the [fire basket comparison](/hub/outdoor-fire-pits/fire-basket). The rules below were checked against GOV.UK, Defra and UK fire-service pages on 20 October 2026. This is not legal advice and not a lab test. A qualifying purchase through our links can earn a commission at no extra cost to you.

Smoke control is a chimney rule

GOV.UK says outdoor barbecues, chimineas and garden bonfires are allowed in a smoke control area. Outdoor smoke is not the chimney offence. The England page gives a chimney penalty of up to £300, and up to £1,000 for buying unauthorised fuel for a non-approved appliance.

Waste, neighbours, roads

You cannot burn household waste if it pollutes or harms health. Defra says compost wet garden waste. The council can investigate a statutory nuisance under the Environmental Protection Act 1990, section 79, in England and Wales. Nuisance is regular or substantial smoke, not one evening. Dorset and Buckinghamshire say there is no ban and no fixed hours. Section 161A of the Highways Act 1980 covers smoke that endangers a carriageway user, with a fine up to level 5. Do not convert level 5 into a pound figure.

Where it sits

There is no single UK distance. Scottish Fire and Rescue say at least three feet from fences, sheds and trees. That is their advice, not the law of England. Essex say well away from buildings and trees. Mid and West Wales say not on decking. Put the pit on bare earth or stone. Lighting and ash are on how to use a fire basket.

Which of these listings say outdoor

Choosing grate, cage or mesh is on the fire basket buying guide. The VonLux is sold for the garden and camping, at 690 g and £13.75, and reviews report holes. The Thorness title says indoor or outdoor, with 5.0 from two reviews and no text. The Almineez bullets include a garden fire pit, at 18 cm wide. The Fire Vida at £18.99 names indoors or outdoors. The Inglenook field says indoor. The JVL and both AB Tools grates are fireplace parts. If the listing never says outdoor, leave it in the hearth.

Common questions

Can I light a fire basket in a smoke control area?
Outdoors, yes, with the other rules still in force. GOV.UK says outdoor barbecues, chimineas and garden bonfires are allowed in a smoke control area. The chimney offence is separate. You still must not burn household waste, and smoke that crosses a road or becomes a statutory nuisance can bring a fine or an abatement notice. The listing also has to say the product is for outdoor use. A hearth grate is not automatically a garden basket.
Does that include an indoor open fire?
No. In a smoke control area an indoor open fire needs authorised fuel or an exempt appliance. A fireplace grate in this set is not an exempt stove. Wood on that grate can be the chimney offence even on a night when a garden fire would be allowed. The England page states penalties up to £300 for the chimney offence and up to £1,000 for buying unauthorised fuel for a non-approved appliance. Other nations should check with their council.
What must I not burn?
Household waste, treated or painted wood, and wet garden rubbish. GOV.UK says you cannot burn household waste if it pollutes or harms health. Defra says compost wet garden waste. Petrol and other accelerants are the fire-service ban, not a lighting tip. Dry, untreated wood is the fuel these pages describe. Clearing the shed into the pit is how a garden fire becomes a nuisance case.
How far from a fence does it have to be?
There is no single UK distance. Scottish Fire and Rescue say at least three feet from fences, sheds and trees. Essex say well away from houses, garages, sheds, fences and trees. Mid and West Wales say not on decking and not near sheds or fences. Northumberland’s 10 metres is a barbecue line, not a basket rule. Look up your own fire service, use a non-combustible base, and put the embers out.
Is there a legal time of day?
No national clock. Dorset and Buckinghamshire say there is no ban and no fixed hours. Councils often advise you to avoid weekends and still evenings. That is advice, not a statute that makes Saturday illegal. Nuisance is about regular or substantial smoke. One brief fire is not the same as a pile of wet waste every Friday. If your council publishes its own hours, follow that page.
Which products in this set are even for the garden?
The VonLux is sold for the garden and camping. The Thorness title says indoor or outdoor. The Almineez bullets include a garden fire pit. The Fire Vida at £18.99 names indoor or outdoor use. The Inglenook field says indoor. The 18 inch Fire Vida does not answer. The other grates are fireplace parts. A garden claim with two reviews and no text, or with mesh holes in the reviews, is still a weak product. The law does not improve the listing.
What if smoke crosses the road?
Move the fire or put it out. GOV.UK says you can be fined if smoke drifts across a road and endangers traffic. Section 161A of the Highways Act 1980 covers fire or smoke that endangers a carriageway user, with a fine up to level 5. Do not translate level 5 into a cash figure. If the wind is towards the lane, that is the evening you do not light.
