Barbecue smoke control area: outdoor cooking rules

A barbecue smoke control area still allows an outdoor grill. The £300 chimney penalty is a different rule, and a lease or balcony ban can still stop you.

You have a small garden behind a terrace, a bag of charcoal, and a neighbour telling you the street is covered. A barbecue smoke control area still lets you use an outdoor barbecue. GOV.UK says outdoor barbecues, chimineas, fireplaces and pizza ovens may be used. The England penalty of up to £300 is for smoke from a chimney, which is a different sentence on the same page.
Products Compared checked the GOV.UK smoke control rules, the garden bonfires page linked from them, and London Fire Brigade's barbecue guidance in October 2026. We did not measure smoke, and an amazon.co.uk listing is not a council letter. A qualifying purchase through our links can earn us a commission at no extra cost to you.
In short
GOV.UK allows outdoor barbecues in a smoke control area. The England maximum of £300 is for chimney smoke, and £1,000 is for buying unauthorised fuel for an appliance that is not approved. A freestanding garden barbecue is the outdoor case. A building chimney, a statutory nuisance, a lease and a balcony each have their own limit.
What a smoke control area actually restricts
A smoke control area limits the smoke a chimney may release. On the same GOV.UK page, outdoor barbecues, chimineas, fireplaces and pizza ovens may be used, and a chimney on a building needs authorised fuel or an exempt appliance. Those are two rules. A neighbour who says you cannot light anything has folded them into one.
England publishes two ceilings. Smoke from a chimney can bring a penalty of up to £300, and buying unauthorised fuel for an appliance that is not approved can bring a fine of up to £1,000. Both are maximums. A kettle on the lawn, with its own bowl and lid vent, is the outdoor case, and the chimney figure is the number people stick on that lid.
The boundary is the council's, and it can change from street to street. A postcode sometimes covers both sides of an older order, so ask with the full address, including the flat, and keep the reply.
Scotland, Wales and Northern Ireland run their own arrangements. Keep the £300 and £1,000 figures for an England address, and ask the council for any other.
Can you barbecue in a smoke control area
You can barbecue in a smoke control area when the barbecue is outdoors and the smoke is not going up a building chimney. Charcoal in a kettle, lumpwood in a cart and gas on a patio trolley all sit in that group while they stand in the open and vent there. The page does not rank brands or set a maximum cooking time.
Dry charcoal, a chimney starter used in the open and a lid on the bowl keep the fire hotter and the smoke shorter. Damp briquettes with the lid off are how a lawful cook becomes a complaint. A visible plume is not the chimney offence, but a plume through next door's windows for hours is the nuisance problem further down.
Chimineas and outdoor pizza ovens are on the same list. An outdoor pizza oven stays in the outdoor case while the smoke leaves in the open air, and it moves to the chimney test once you connect it to a building. A London park or a heath is the landowner's rule, so read the site before you travel with a disposable tray.
When a chimney changes the answer
The answer changes when smoke enters a chimney on a building. GOV.UK then asks for authorised fuel or an exempt appliance. A summerhouse, a garden office, a lean-to and the house all count as buildings. A flexible flue through a shed roof or a disused fireplace leaves the outdoor case, even if the bowl still stands on the grass.
Authorised fuel is the smokeless fuel the rules allow in that chimney. An exempt appliance is one named model, cleared for a named fuel and used as the exemption states. A kettle, a gas cart or a pizza oven does not inherit a living-room stove's exemption, so ask the council before you light any duct into a building.
When a garden fireplace is built into a wall, look at the top of the flue. Smoke from a short stack on a freestanding bowl is one case, and smoke from the house's chimney pot is the other. If you cannot tell, ask the council with a photo of the terminal. Products Compared has not classed any barbecue in this hub as an exempt appliance.
Nuisance, leases and balconies
The Environmental Protection Act 1990 lets the council treat smoke as a statutory nuisance when it unreasonably interferes with neighbours. Permission to use an outdoor barbecue is not immunity from that. GOV.UK links a garden bonfires page from the smoke-control rules, and a barbecue is a cook, not a heap of wet cuttings, painted wood or household rubbish.
A short, hot fire, a lid in place and a gap from the neighbour's windows is what a permitted cook looks like on a tight street. Lighting as their washing goes out, or running a cold smoky fire until midnight, is how a nuisance file starts. If the smoke is in their rooms and they ask you to stop, stop.
A lease can ban the garden or the balcony after smoke-control law has allowed an outdoor barbecue. The clause binds you because of the tenancy, not because the map changed, so read it before you buy a cart. The balcony barbecues, leases and fire risk guide goes through that in detail.
London Fire Brigade tells you not to use a barbecue on a balcony. That note is fire guidance, about spread into the flats, and it is separate from the smoke-control statute. Gas does not remove a lease ban or that warning. If the only outdoor space is a balcony, cook indoors and keep charcoal for open ground you are allowed to use.
What to buy if you still want to cook outside
Buy for the garden you can use. The street rule does not prefer charcoal or gas. It asks where the smoke goes, so settle the council and the lease before you pay.
The Weber barbecue comparison's top pick is the Weber Go-Anywhere charcoal, model 1131004, listed at about £100.79 with 4.7 from 1,645 amazon.co.uk reviews. Folding legs lock the lid for carrying. In the same comparison, the Weber Original Kettle Premium 57 cm is listed at about £239.00 with 4.5 from 117 reviews, on a stand with wheels. Shelf prices move, and neither listing is an exemption.
If you would rather run gas, the Weber gas barbecue comparison covers that range. Check that the data plate and the regulator describe the same cylinder before you buy. A mismatch there is a gas fault, not a smoke-control shortcut.
When a lease closes the garden, a Tefal electric grill is a kitchen appliance on a 13 amp plug, and it does not justify charcoal on a balcony. Light a real barbecue in the open and put the coals out before you go in, because charcoal and gas both make carbon monoxide under an awning, in a garage or in a tent.
