Soaker hose hosepipe ban

Updated: 23 October 2026

A dry week arrives and a product page talks as if a porous hose were a permit. On mains water in England and Wales, a soaker hose is allowed only when your notice’s drip or trickle exception matches the hardware you have fitted. The hose type does not answer it. How to lay it, once the tap is allowed, is on [how to lay a soaker hose](/hub/garden-watering/soaker-hose/sub/soaker-hose-how-to-lay). Which listing to buy is on the [soaker hose comparison](/hub/garden-watering/soaker-hose). A qualifying purchase can earn a commission at no extra cost to you.

Why the hose does not answer the question

Section 76 of the Water Industry Act 1991 lets an undertaker in England and Wales ban hosepipe use for a garden or for plants when it thinks a serious shortage exists or may exist. Section 76A(5) counts as a hosepipe anything used for the same purpose. A soaker on mains water is still a hosepipe. The statute does not create a private exemption for a weepy wall. A water-saving line is not permission until you have read the notice for your postcode. Buyers on the MAMIZO, B2C and Gardena captures who say their company allowed a leaky hose are describing their own street, not yours.

What the published exceptions actually require

Where a company publishes a drip or trickle exception, the conditions repeat. Thames Water allows an approved system with a pressure-reducing valve and a timer, not handheld, putting water drip by drip on or under the soil without runoff or spray. Affinity Water’s Central notice sets prohibitions from 00:01 on 17 July 2026 and uses the same pattern. That date is not a national start. South East Water’s Sussex FAQ follows the same drip conditions and adds stored rainwater. A jetting soaker fails the no-mist line. An up to 70% claim does not satisfy a valve, a timer or a no-spray condition. None of the five boxes includes the timer the notices name, or a pressure-reducing valve. Gardena’s control valve is aimed at 0.5–1 bar. That is a flow valve in the product text. It is not automatically the valve a notice means, unless the notice’s words accept it.

Water butts, pots, and greenhouses

Stored rainwater is generally outside a mains ban, because the ban bites on the company’s supply. A soaker from a butt filled before the ban, or from a roof-fed butt, is a different source. Do not refill that butt from the mains while the ban is on. The Water Use (Temporary Bans) Order 2010 takes outdoor pots and plants under cover out of the word garden for some purposes. Purpose (c) can still cover watering plants on domestic premises, so a greenhouse on mains water is not automatically exempt. Read the purpose lines. The maximum fine is level 3 on the standard scale. Under section 122 of the Sentencing Act 2020, level 3 is £1,000 for offences on or after 1 October 1992. That is a maximum, not a fixed penalty.

If your supplier is not on this list

England and Wales are the area section 76 covers. Scotland and Northern Ireland are not decided here. Inside England and Wales, a company with no drip or trickle exception does not become Thames Water because a soaker is gentle. Do not water the garden from the mains with this hose in that case. Stored rainwater, or waiting for rain, is the alternative the FAQs describe. The buying guide covers working pressure if you are allowed to run the hose. The drip line comparison is about a slope, not whether the tap is legal today.

Common questions

Is a soaker hose a hosepipe in law?
Under section 76A(5) of the Water Industry Act 1991, a hosepipe includes anything used for the same purpose. A soaker on mains water in England or Wales is in that definition. An exemption exists only when your current notice writes one, and only if you meet every condition.
What three conditions do the 2026 notices repeat?
Thames Water, Affinity’s Central notice and South East Water’s Sussex FAQ allow a drip system that is not handheld, uses a pressure-reducing valve and a timer, and puts water on or under the soil without mist or runoff. You need all of those. Affinity’s 00:01 on 17 July 2026 is the Central region only.
Does a printed 70% saving create an exemption?
No. The up to 70% line is a claim about water use compared with sprinklers. A ban notice does not accept it as a pressure-reducing valve or a timer. A buyer’s own company is not a national rule you can reuse.
Can I run it from a water butt?
Yes, if the water is stored rainwater or was stored before the ban, and you are not topping the butt up from the mains. The ban is on the undertaker’s supply. Lay the hose so it weeps into the soil rather than across a path.
Can I fill that butt from the mains during the ban?
Commonly, no. Filling a water butt from the mains with a hosepipe, while a temporary ban is in force, is treated as prohibited use in the company FAQs used here. Fill it from the roof, or before the ban starts.
Are greenhouse pots automatically exempt?
No. The 2010 Order takes plants under cover out of the defined word garden, and a notice can still ban watering plants on domestic premises. A greenhouse soaker on mains water needs the same drip exception if your notice bans plant watering.
Does this answer apply in Scotland?
No. Section 76 is the England and Wales power. Scottish and Northern Irish suppliers publish their own drought rules, and this page does not state them. The £1,000 figure is the level 3 maximum under the Sentencing Act 2020, and it is a maximum, not a fixed fine.
