Fire pit smoke control area

Updated: 22 October 2026

You live on a UK terrace and want to know whether a fire pit in a smoke control area is banned. It is not banned by the chimney rules. GOV.UK says you can use an outdoor barbecue, chiminea, fireplace or pizza oven in a smoke control area. The same smoke can still be a statutory nuisance, and a smokeless title decides neither test. How to lay a small fire is [how to light a chiminea](/hub/fireplaces-and-stoves/outdoor-fireplace/sub/outdoor-fireplace-how-to-light). The product table is the [outdoor fireplace comparison](/hub/fireplaces-and-stoves/outdoor-fireplace). GOV.UK, Defra and Newcastle City Council were used. The enforcement note is for English councils. A purchase through our links can earn a commission at no extra cost to you.

What a smoke control area does not ban

A smoke control area restricts smoke from a building’s chimney. It does not, on GOV.UK’s page, forbid a chiminea or a fire pit standing outdoors. You can use outdoor barbecues, chimineas, fireplaces or pizza ovens in a smoke control area. A shop article that demands a Defra-exempt appliance for a garden chiminea is applying the building rule to the patio. The English enforcement guide says outdoor burning is not covered by the chimney rules. If smoke harms someone or becomes a nuisance, the council still has the abatement route under the Environmental Protection Act 1990. In England, the penalty of up to £300 is for chimney smoke, not a fine to paste onto a patio bowl.

When it is a building chimney

The exception flips when the fire uses a chimney on a building. GOV.UK then expects authorised fuel or an appliance exempt for smoke control areas. A summerhouse or cabin with a flue through the roof is that case. A freestanding chiminea on slabs is the outdoor case. The LIVIVO Palacio is a 112 cm garden chiminea, not a flue on a house. Piping a stove out of a summerhouse wall is the moment to use a fitter or ask the council which appliance they will accept. Smoke from a bowl on the patio is outdoor burning. Smoke through a pipe fixed to a roof is the building rule. A smokeless title does not make a building flue exempt.

When smoke becomes a council matter

Nuisance is a different statute from smoke control. GOV.UK describes smoke that substantially interferes with the use of a home, or that injures health. Councils must look into a complaint. If they agree it is a statutory nuisance, they must serve an abatement notice, which can restrict the burning. Newcastle City Council says a regular problem is the usual case, and a single extreme fire can still qualify. One awkward evening is not automatically a notice. A pit every Friday that fills a bedroom is the pattern the test is built for. Defra also points at smoke that endangers traffic. You must not let smoke drift across a road so that it becomes dangerous. If a fire has spread, leave and call 999.

Fuel, smokeless, and the lease

Dry untreated wood changes complaints, and it is not a legal shield. Ready to Burn, at 20% moisture or less, is the England sale rule for wood under 2 cubic metres. Do not burn household waste or painted fence panels. The Generic ZML cylinders are sold as smokeless. Reviewers still report smoke at lighting for about 10 to 15 minutes, and they say the burn is not smoke-free. The Gonggi smokes when the flame drops. L&Q tells its residents not to use fire pits or chimineas on balconies, or in gardens they do not own, and it uses a three-metre figure. That is L&Q’s rule, not a national clearance. If the tenancy forbids open flames, read it before you buy a chiminea you cannot light.

Common questions

I live in a smoke control area. Can I light a patio chiminea?
Yes, as an outdoor appliance. GOV.UK says outdoor chimineas, fireplaces, barbecues and pizza ovens can be used in a smoke control area. You do not need a Defra-exempt certificate for that patio use. You still have to avoid statutory nuisance, and you still cannot burn household waste.
What if the flue is on a summerhouse?
Then it is a chimney on a building, and the outdoor exception does not cover it. Authorised fuel or a Defra-exempt appliance is the GOV.UK requirement. A chiminea beside the summerhouse is a different object from a stove piped through the wall. Ask the council before you cut a hole.
Can my neighbour make the council stop me?
They can complain, and the council must investigate smoke that may be a statutory nuisance. If officers agree the smoke substantially interferes with a home, they must serve an abatement notice. A neighbour cannot invent that notice. They do not have to live with smoke every weekend.
Does one smoky evening count?
Usually the case is repetition. Newcastle says a regular problem is typical, and a single extreme fire can still qualify. One damp lighting, stopped when you see the smoke, is not the same as a bonfire that fills a house. Treat a bad evening as a warning.
Does a smokeless pit opt me out of the rules?
No. The nuisance test does not ask what the title says. ZML reviewers still report startup smoke and say the fire is not smoke-free. Gonggi owners report smoke when the flame falls. The marketing word is not a defence against an abatement notice.
Can I burn old fence panels or cardboard?
No. Fence panels are often painted or treated, and cardboard piled as rubbish is household waste. GOV.UK tells you not to burn household waste in the garden. Dry untreated firewood, or the charcoal the listing names, is the fuel.
I am a tenant. Is the law the only rule?
No. The tenancy can forbid a fire pit even when GOV.UK allows an outdoor chiminea in a smoke control area. L&Q bars them on balconies and in gardens residents do not own. If the lease bans open flames, ask the landlord in writing before you buy.
