Nanny cam UK

Updated: October 2026

A nanny cam in the UK is not automatically lawful because it records inside your home. Watching a pet in a room you control can begin as ordinary household use. Routinely filming a nanny, cleaner, or gardener who works there is worker monitoring under the ICO's published guidance. The camera's size, product title, and Wi-Fi connection do not change that distinction. This page is the decision before you use anything from our [spy cam comparison](/hub/diy-supplies/spy-cam). It is not legal advice, and no model is a legal nanny cam. Peter F., DIY & tools editor, separated the purpose from the hardware. A pet in your own home

A camera on a dog in the living room, or a cat at a feeding area, starts as household use when the lens stays inside property you control and no worker is routinely in frame. Frame only that area, decide whether you need audio, protect the footage, and delete it when the purpose ends. A neighbour's home, the street, or a communal corridor brings data-protection duties: minimise, sign, secure, and respond. Do not post the clip. Audio is highly intrusive because a microphone can collect talk beyond the picture. A shortlist by job is best spy camera by job.

A nanny, cleaner, or gardener in the frame

The same camera changes context when someone is paid to work in the home. The ICO's worker-monitoring guidance covers an employer who monitors a visiting worker, such as a nanny or gardener, routinely or on an ongoing basis. A cleaner sits in the same practical category. My house does not end the question. Ask whether you employ the person, whether the filming is routine, and what purpose you can justify. Be ready for a subject-access request. An app and a local card are the same legal question. The Wi-Fi or no-Wi-Fi guide only decides how a clip reaches you.

Tell staff, with one narrow covert exception

GOV.UK says tell staff that they are being monitored and why: what is recorded, when, who can see it, and how long you keep it. A product called a nanny cam does not remove that duty. Monitoring should answer a defined need, not run all day because the hardware can. The covert exception is narrow. It is for a specific investigation where you suspect a worker is breaking the law and telling them would make detection difficult, and you stop when that investigation ends. It is not a licence to record every shift. An amazon.co.uk listing is not an investigation plan.

Toilets, bathrooms, and the criminal line

Do not monitor toilets or bathrooms, and do not put a camera in someone else's bedroom. GOV.UK says staff monitoring should not take place in toilets. A voyeuristic recording is a criminal matter, separate from data protection. England and Wales use section 67 of the Sexual Offences Act 2003 and the Voyeurism (Offences) Act 2019. Scotland uses section 9 of the Sexual Offences (Scotland) Act 2009. Northern Ireland uses Article 71 of the Sexual Offences (Northern Ireland) Order 2008. Telling a worker, or choosing a clock, charger, pen, or key, does not make a prohibited recording lawful. We do not explain how to hide a camera from somebody who should not be filmed.

The street, the soundtrack, and when to get help

Narrow a test frame that takes in a neighbour, a pavement, or a shared hall before you keep it. Where that capture cannot be avoided, sign it, secure it, delete it, and answer access requests. Keep the date and time accurate, and do not publish the clip. A phone alert does not justify continuous sound. Call a professional for a neighbour dispute, for worker monitoring beyond that narrow covert test, or for a let property or a shop floor. Hardware, once the purpose is lawful, is the spy camera buying guide.

Common questions

Is a nanny cam legal in the UK?
No product is a legal nanny cam. Routine filming of a nanny, cleaner, or gardener is worker monitoring under ICO guidance, so you need a justified purpose and you must normally tell the worker. Toilets, bathrooms, and someone else's bedroom remain out of bounds. The camera's title does not change that.
Is filming my pet the same as filming my nanny?
No. Filming a pet inside property you control can begin as ordinary personal or household use. A nanny who is monitored routinely or on an ongoing basis is a visiting worker under the ICO's worker-monitoring guidance. The same camera can therefore move from a household activity to employment and data-protection duties because the subject and the purpose changed.
Do I have to tell a cleaner or gardener?
GOV.UK says staff should be told that they are being monitored and why. The narrow covert exception is a specific investigation where you suspect law-breaking and disclosure would frustrate detection. Monitoring then stops when that investigation ends. It is not a standing exception for cleaners, gardeners, nannies, or other visiting workers.
Can I record in a bathroom or toilet?
No. GOV.UK says staff monitoring must not take place in toilets, and this guide treats bathrooms and someone else's bedroom as prohibited locations too. Voyeurism offences are criminal law, separate from data protection. A notice, an app setting, or a product marketed as a nanny cam cannot make a prohibited recording acceptable.
What if the camera sees the street?
Once domestic CCTV captures beyond your property boundary, the ICO says data-protection rules apply. Minimise the view, provide signs, keep footage secure, delete it when you no longer need it, and respond to requests from people shown. Do not post clips on social media. If a neighbour dispute develops, get professional advice rather than widening the view.
Does telling staff make every recording lawful?
No. Notice does not override criminal law, remove the need for a justified purpose, or permit recording in a toilet, a bathroom, or someone else's bedroom. You must still minimise what you collect, protect the footage, and follow ICO guidance. Consent wording is not a universal cure.
